EB-1A
Extraordinary Ability

EB-1A is for individuals who can show extraordinary ability in their field through sustained national or international acclaim. Unlike many employment-based categories, it may allow self-petitioning — making it especially powerful for accomplished professionals.

Who Qualifies

A Direct Path to the Green Card

EB-1A is available to individuals who have risen to the very top of their field — researchers, professors, physicians, athletes, founders, artists, engineers, and other professionals whose work has made a meaningful impact in their discipline. The standard is high, but so are the benefits: no job offer required, no employer sponsorship needed, and no labor certification process.

To qualify, an applicant must demonstrate extraordinary ability through sustained national or international acclaim. USCIS evaluates this through a set of regulatory criteria — including awards, publications, critical roles, high salary relative to peers, judging others in the field, and contributions of major significance — and then considers the overall record to determine whether the applicant has truly risen to the top of the field.

Case Strategy

Evidence & Presentation

These cases require both strong evidence and a clear legal presentation. The goal is not just to list credentials — it is to build a narrative that shows why the applicant's accomplishments reflect a level of recognition that sets them apart from others in the field.

When done well, EB-1A can provide a direct and powerful path to permanent residence for individuals whose work has already made a meaningful impact. It is often one of the most rewarding cases to build — because it tells the story of what someone has truly achieved.
