The EB-2 NIW may be available to professionals with advanced degrees or exceptional ability whose proposed work has substantial merit and national importance — allowing them to bypass the usual job offer and labor certification requirements.

The EB-2 category requires either an advanced degree (or its equivalent) or exceptional ability in the sciences, arts, or business. The NIW prong then allows an applicant to request that the usual job offer and labor certification requirements be waived — on the grounds that it is in the national interest of the United States to do so.

USCIS evaluates NIW petitions under a three-part test: the proposed endeavor must have substantial merit and national importance; the applicant must be well-positioned to advance that endeavor; and it must be beneficial to the United States to waive the job offer requirement for this individual.
